Terms & Conditions

Chef's Marche is a business-to-business (B2B) digital procurement platform (hereinafter referred to as "Chef's Marche," "We," "Us," or "Our"). These Terms and Conditions ("Terms") govern your use of the chefsmarche.com website, mobile application (the "Platform"), and the supply of goods and services by us to you.

By accessing, browsing, or placing an order through the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.

1. Scope of Agreement and Eligibility


1.1. Nature of Business

Chef's Marche is exclusively a B2B procurement platform. By accepting these Terms, you warrant that you are purchasing goods solely for commercial, professional, or institutional purposes (Hotels, Restaurants, Caterers - HoReCa) and not for personal consumption or individual resale.


1.2. Eligibility

You must be a legally registered business entity or a representative authorized by such an entity to conduct business in India and must be at least 18 years of age to enter into a binding contract.


1.3. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of India. Subject to Section 9 (Dispute Resolution), all disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in India.


2. User Accounts and Registration


2.1. Account Creation

To access the platform's procurement services and wholesale pricing, you must create an account. You agree to provide accurate, complete, and current registration information and to keep this information updated.


2.2. Confidentiality

You are responsible for maintaining the confidentiality of your account login credentials (username and password) and for all activities that occur under your account. You must notify Chef's Marche immediately of any unauthorized use of your account.


2.3. KYC and Verification

We reserve the right to verify your legal business status through Know Your Customer (KYC) documentation, including but not limited to, Goods and Services Tax (GST) registration, FSSAI license, and trade licenses. Your access may be suspended or terminated if verification fails or is incomplete.


3. Order Placement, Pricing, and Payment


3.1. Order Finality

All orders placed through the Platform are considered a binding offer to purchase the goods. Orders are subject to acceptance and availability by Chef's Marche. Order confirmation does not constitute final acceptance until the goods are dispatched.


3.2. Pricing and Taxes

All prices listed on the Platform are wholesale, commercial prices and are exclusive of applicable taxes (GST, duties, etc.), unless explicitly stated otherwise. Applicable taxes will be calculated and added during the checkout process based on the delivery location and the nature of the goods.


3.3. Payment Terms

Payment shall be made through the approved payment methods listed on the Platform (credit card, debit card, UPI, net banking, etc.). For eligible B2B partners, approved credit/payment terms are subject to a separate written agreement and may be suspended or revoked at any time at our sole discretion.


3.4. Minimum Order Value (MOV)

Orders must meet the minimum order value as specified on our Delivery Information page. Orders below the MOV may be rejected or incur an additional service charge.


4. Delivery, Acceptance, and Commercial Warranties


4.1. Delivery Window

Delivery will be attempted within the time slot selected by you during checkout, as detailed in our Delivery Information Policy. While we aim for punctuality, delivery times are estimates and we are not liable for reasonable delays caused by unforeseen circumstances (e.g., traffic, road closures, severe weather).


4.2. Mandatory Acceptance and Inspection

This is a B2B transaction. Upon delivery, you or your authorized personnel must immediately and thoroughly inspect the goods for quantity, quality, and condition.

  • Any shortage, quality defect, or visible damage must be noted on the delivery manifest and communicated to the delivery personnel at the time of delivery.

  • The signed delivery manifest serves as conclusive evidence that the goods were delivered and accepted in the specified quantity and satisfactory condition.


4.3. Commercial Warranty

Chef's Marche warrants that, upon delivery, the goods shall conform materially to their specifications and be of merchantable quality. We do dont offer any refunds, due to perishability of product nature.


4.4. Limited Returns and Cancellation

  • Perishable Goods: Given the nature of our products (fresh produce, dairy, meat), we do not accept returns after the goods have been accepted and signed for, unless a defect was identified at the time of inspection.

  • Cancellation: Orders can only be cancelled before the cut-off time specified on the Platform. Once processing has begun, cancellation is not permitted.


5. Limitation of Liability


5.1. Exclusion of Indirect Damages

To the maximum extent permitted by Indian law, Chef's Marche, including its affiliates, directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the service;

  • Any unauthorized access to or use of our servers and/or any personal information stored therein;

  • Any interruption or cessation of transmission to or from the service.


5.2. Cap on Liability

In no event shall the total aggregate liability of Chef's Marche to you for any and all claims arising out of or related to these Terms or the services provided hereunder exceed the amount paid by you to Chef's Marche for the specific goods giving rise to the claim during the three (3) months immediately preceding the date on which the claim arose.


6. Intellectual Property

All content on the Platform, including text, graphics, logos, images, software, and trade names ("Chef's Marche"), is the property of Chef's Marche or its content suppliers and is protected by Indian and international copyright and intellectual property laws. Your use of the Platform grants you no right or license to reproduce or otherwise use any Chef's Marche trademarks or third-party trademarks.


7. Indemnification

You agree to indemnify, defend, and hold harmless Chef's Marche and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with: (i) your access to or use of the Platform; (ii) your breach of these Terms; or (iii) your violation of any applicable law or the rights of a third party.



8. Dispute Resolution

Any dispute or difference arising between the parties concerning these Terms shall first be referred to mandatory binding arbitration under the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a single arbitrator appointed mutually by both parties. The seat and venue of the arbitration shall be Jalandhar, and the language of the proceedings shall be English.


9. Modification of Terms

Chef's Marche reserves the right to modify these Terms at any time by posting the revised Terms on the Platform. Your continued use of the Platform after any such modification constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically
